  • Annual revenue and fees billedThis coverage is usually rated on your billings, because more work for more clients means more chances for a mistake to cost someone money.
  • The clients and contracts you take onA handful of large, high-value engagements can be riskier than many small ones, and clients with deep pockets and lawyers on retainer are more likely to pursue a claim.
  • The limit you chooseOn some policies legal defence costs are paid within your limit, and on others they are payable in addition to it. Your declarations page sets out which, and we size the limit with that in mind. Some Alberta professional bodies also set a minimum you must carry.

How is it different from general liability?

General liability covers injury or property damage that happens around your business: a client trips in your office, or slips on a wet floor in your salon. Professional liability responds to the service itself. For advisory work that is the money a client loses because of your advice. For a hands-on personal service it is harm caused by the treatment, like a chemical burn or a reaction, which general liability usually will not cover. Many businesses need both, and we will tell you which apply to you.

Who needs professional liability insurance?

Anyone paid for their expertise or a defined service. That includes consultants, accountants, engineers, architects, IT and software providers, real estate and insurance professionals, designers, and agencies, where the risk is a client claiming your work cost them money. It equally includes personal-service businesses, salons, spas, estheticians, lash and brow artists, massage therapists, and tattoo and piercing studios, where the risk is a client claiming the treatment harmed them. In Alberta, some professions, such as insurance brokers, lawyers, and real estate agents, are required by their professional body to carry it.

Does it cover claims even if I did nothing wrong?

Yes, and that is much of its value. Defending yourself against a claim is expensive whether or not you were actually at fault. This coverage pays your legal costs from the start, so an unfair claim does not come out of your own pocket while you prove you did your job properly.

Does the timing of a claim matter?

Usually yes. This type of policy has to be active when the claim is made against you, not just when you did the work, and it covers work you did on or after a start date set in your policy. That is why keeping your coverage going without a break matters, and why cancelling an old policy can leave a gap. We will explain how the dates work and keep your coverage continuous.

What does professional liability not cover?

It has limits. It generally does not cover deliberate, dishonest, or fraudulent acts, physical injury or property damage (those belong on your general liability), broken contracts and fee disputes, or claims you already knew about before the policy started. Keep in mind that how legal defence costs are treated varies by policy: on some they are paid within your coverage limit, and on others they are payable in addition to it. What happens to my coverage if I retire, sell, or switch insurers?

Because this coverage only responds while a policy is active, a claim that arrives after your policy ends is not covered, even for past work, unless you buy an extension. That extension keeps you protected against late claims tied to work you already finished, and it is worth arranging when you retire, sell the business, or change insurers.
